Former President Trump is seeking relief from the U.S. Supreme Court. On Tuesday, his legal team formally requested the Supreme Court to intervene in his dispute with the Justice Department regarding documents seized from his Mar-a-Lago home on Aug. 8.
Trump’s filing petitions the Supreme Court to “lift a stay granted by the U.S. Court of Appeals for the 11th Circuit that allowed the Justice Department to review more than 100 classified records taken from Mar-a-Lago during its August search,” according to The Hill.
Trump’s lawyers argue that the federal appeals court erred by allowing the Justice Department to appeal a move that was procedural in nature.
In their filing, Trump’s lawyers note that “the Eleventh Circuit granted a stay of the Special Master Order, effectively compromising the integrity of the well-established policy against piecemeal appellate review and ignoring the District Court’s broad discretion without justification. This unwarranted stay should be vacated as it impairs substantially the ongoing, time-sensitive work of the Special Master.”
Last month, the 11th Circuit’s three-judge panel reversed Judge Canon’s ruling and gave a green light for the Justice Department to review the classified records taken from Trump’s home.
Canon had agreed with Trump’s attorneys and granted the request for a special master. Further, she stipulated that all records should be reviewed by a special master — something the special master has since declined to do — and halted further review by the FBI pending a report by the special master.
The 11th Circuit Court ruled that Judge Aileen Cannon “erred” in her ruling and questioned whether a special master should have been appointed.
The Court wrote: “Plaintiff has not even attempted to show that he has a need to know the information contained in the classified documents. Nor has he established that the current administration has waived that requirement for these documents.”
Trump’s legal team is now appealing the 11th Circuit’s ruling to the U.S. Supreme Court.
The Justice Department is moving to expedite a challenge to the 11th Circuit to effect the removal of the special master appointed to the case.
